MANUAL I

Particulars of Organization, functions and duties
As per Ordinance XVIII of the University of Delhi which is already available on University of Delhi Website: www.du.ac.in and is a constituent college under 12(f) of University Grants Commission and Section 2 of the University of Delhi

 

DEFINITIONS

 

  1. ‘College’ means an institution maintained or admitted to its privileges by the

University and includes an Affiliated College and a Constituent College:

Explanation-I-/affiliated College’ means an institution recognized by the University in accordance with the provisions of this Act and the Statues in which instructions  is provided in accordance with the provision of the statutes and the ordinances upt the Bachelor’s degree, but exclusive of Honours and Post-graduate degree.

Explanation-II-‘Constituent College’ means an institution recognized as such by the Executive council in accordance with the provisions of this Act and the Statutes; (Section 2 of the Act)

  1. ‘PRINCIPAL’ means the Head of a College, the person for the time being duly appointed to act as Principal and in the absence of the Principal or the acting Principal, a Vice-principal duly appointed as such;
  2. ‘TEACHERS’ includes Professors, Readers, Lecturers and other persons imparting instruction in the University or in any College or Hall.
  3. ‘TEACHERS OF THE UNIVERSITY’ means persons appointed or recognized by the University for the purpose of imparting instruction in the University or in any college. (Section 2 of the Act).
  4. The Colleges shall be such as may, after the commencement of the Delhi University (Amendment) Act, 1943,  recognized by the Executive Council in accordance with this Act and Statutes but shall include all Colleges recognized at the commencement of the said Act as Colleges of the University so long as such recognition continues. (Section 34 of the Act).

 

Motilal Nehru College initially known as Hastinapur College, has been renamed in the name of great freedom fighter late Pandit Motilal Nehru College.  It is one of the first and foremost colleges established by Delhi Administration in 1964. Starting with all the three faculties of Arts, Science and Commerce, it was housed in a senior secondary school building at Moti Bagh where we spent a long span of twenty five years before moving to this sprawling camous in 1989. Here we feel we are well poised to take big strides in all direction. The Departments of Hindi, Political Science & Co0mmerce are being run at the post graduate level also besides undergraduates course in all other departments of the college.  The present strength of our  college students is around 2700+ which will further likely to rise in the third year of obc reservation next year. Water Scarcity has always been a problem in this part of Delhi, but we have tided over it to a great extent by building  a huge underground reservoir. A spacious library building is almost complete. it is soon to be followed by an auditorium that is so very necessary for the academic, cultural and cocurricular activities  of the college. We have also constructed a spacious canteen for our  students and staff. The college has a spacious, well laid out playground where we propose to provide all necessary games and sports facilities. Separate and ample parking spaces have been marked for our staff and students and adequate security arrangements have been made  all over the campus.  We are fast acquiring adequate infrastructure for efficient functioning of all the departments.  Computers have been installed in the departments of Physics, Chemistry, Mathematics, and college office and Library.  Further the college is in process of having a separate computer lab. in view of changed syllabus and requirements.  Intercom facility has been provided to all the departments, staff room, library and canteen.  Fax facility is actively utilized in the college.  The college has adopted measures to provide facility to physically disabled persons, in this direction even a separate toilet has been provided for them.  In the Library special facility have been provided to visually disabled readers viz staff and students.  Special care has been taken to make the college Zero Tolerance Zone with regard to Ragging.  To maintain all round discipline a discipline Committee of the college works for the betterment of students.  Security Guards have been posted  at strategic points to check identity  cards of bonafide students of the college.

Facilities
            The college Provides facilities to its students like Library, Audio Visual Room
Laboratories, Conference Hall, Cultural Room, Fee collection Desk at college,  Playground , facilities of coaches, Admission Helpline, Xerox facilities, Canteen, NSS centre, NCC wing for both girls and boys, Qualified Medical doctor runs a medical room, RO System for hygenically standardised, generator power back, renovation of infrastructure

MEMORANDUM OF ASSOCIATION OF THE HASTINAPUR (renamed as :  MOTILAL NEHRU COLLEGE SOCIETY, NEW DELHI.

  1. The society shall be named as the  as MOTILAL NEHRU)COLLEGE MOTI BAGH SOCIETY.
  2. The registered Office of the society shall be in the Union territory of Delhi.
  3. The objects for which the Society is established are:-

To establish, develop and maintain the educational institution called the MOTILAL COLLEGE, BENITO JUAREZ MARG AND TO MANAGE, SUPERVISE AND ADMINISTER ITS AFFAIRS.

  1. Subject to the Act, Statutes, Ordinances, Rules and Regulations of the University of Delhi and to the conditions of Government grant, the society shall have the power to do all things and acts necessary and incidentals to the above mentioned objects and without prejudice to the generality of the above to do the following things in particular:
    1. to construct, demolish or alter any building which may be necessary or expedient for its objects,
    2. to provide hostels for students and residential accommodation for staff (teaching and other staff).
    3. to purchase, take on lease or accept as gift, or otherwise acquire, transfer, surrender, give on lease or otherwise alienate any real or personal property or rights therein or privileges attaching thereto which may be necessary or convenient for its purposes,
    4. to buy, sell, endorse, negotiate or transfer, Government or other securities, negotiable instruments including Hundis and to collect and realize interest, bonus, dividends and profits on such securities, negotiable instruments etc., for the purpose of the Society,
    5. to invest funds belonging to the Society or under the control of the Society in such property and/or  securities as is authorized by law for the investment of trust funds or such other classes of securities as may from time to time be approved by the Government of India or in any other manner as may be specifically approved by the University Grants Commission,
    6. to borrow or raise money for the fulfillment of the objects of the society with or without security by creating a charge, lien or mortgage on whole or any part of its properties, assets, rights or privileges on such terms and conditions and to such extent as may be determined by the Society from time to time,
    7. to do all such other acts other acts and things incidental and ancillary to attainment  of any of the objects specified above as may be expedient for the functioning of the Society as an educational institution,
    8. to appoint, promote, or dismiss, reduce in rank any of the members of the teaching or non-teaching staff of the Society,
    9. to frame rules, regulations, bye-laws for the administration of the Society, provided, however, that such rules, regulations and bye laws shall always be in conformity with the Act, Statutes, Ordinances, Rules, Regulations and Resolutions of the University of Delhi and such other conditions as may be prescribed for Government grant to colleges,
    10. to appoint such committees or sub-committees as may be expedient.

 

  1. The membership of the Society shall be identical with that of the Governing Body. The affairs of the Society shall be vested in and administered by the Governing Body which shall be constituted in accordance with and subject to the provisions of the Act, Statutes, Ordinances, Regulations and resolutions of the University of Delhi.
  2. (a)  All leases, properties, documents and title deeds relating to the properties movable and immovable, of the Society shall be in the name of the Society
  3. The income of the Society from its property or any other sources howsoever derived shall be applied solely towards the promotion of the objects of the  portion thereof shall paid or tr4anferred directly or indirectly by way of bonus or otherwise to the persons, who, at any time, are or have been members of the Society or to any of them provided that nothing herein contained shall prevent the payment in good faith or remuneration to any officer, employees or servant of the Society or to any of them provided that herein contained shall prevent the payment in good faith of remuneration to any officer, employee or servant of the Society or to any member thereof or any other person in return for any services rendered to the Society by such officer, employee or servant.
  4. No member/members of the Society shall be answerable for any loss or damages arising from administration or application of the trust funds or for any damage or deterioration in any movable or immovable property of the Society unless such loss, damage or deterioration is brought about by his/their wilful neglect or default.
  5. the names, address, occupations and designations of present members of the Governing Body of the Society are as follows:-

 

RULES OF THE MOTILAL NEHRU COLLEGE, NEW DELHI-110021

  1. Unless the context otherwise provides:-

 

    1. The expression “Governing Body” occurring hereinafter shall mean the             Governing Body of Motilal Nehru College New Delhi-110021
    2. The expression “University” occurring hereinafter shall mean the University of Delhi.
    3. The expression “College” occurring hereinafter shall mean Motilal Nehru College, maintained and administered by the College Society.
  1. The rules hereinafter contained shall apply to the Society and the College subject to such Acts, Statutes and Ordinances, Regulations and resolutions of the University as are in force and as may be amended or revised from time to time.
  2. The constitution, composition, term of office of members and the Chairmanship of the Governing body of the Society shall be in accordance with Statute 30 read with Ordinance XVIII of the University of Delhi.
  3. A member of the Governing Body shall cease to hold office if he/she-
    1. dies or voluntarily resigns his office,
    2. is adjudged to be an insolvent or of unsound mind,
    3. is convicted of any offence involving moral turpitude,
    4. ceases to hold the qualifications, if any, required for nomination or election or appointment as member of the Society.
  1. No action or proceedings of the Governing Body shall be invalid or called in questions merely by reason of the existence of any vacancy or vacancies among its members, or any irregularity in the nomination or election of any of its members.
  2. As per Ordinance XVIII :The Governing Body shall be the Executive authority of the College. The Governing  shall hold, control and administer the property and funds of the College as well as other funds placed at the disposal of the College for any specific object, It may appoint a  Finance Committee to advise it on matters relating to finance. The Governing Body shall, in addition to other duties vested in it, have the following powers:-

 

    1. To enter into, vary, carry out, confirm and cancel contract on behalf of the college
    2. To consider the Annual Report, the Annual Accounts and the Financial Estimates.
    3. To lay before the University/Delhi Admn./and the University Grants Commission annually a statement of the financial requirements of the college.
    4. To fix admission, tuition and other fees to be charged from students reading and/or residing in the College (subject to any limitations laid down by Delhi University.
    5. To appoint Principal and other members of the teaching staff in accordance with the procedure laid down under Ordinance XVIII.                                    Provided that every teacher shall be appointed under an agreement of service to be executed by the teacher in accordance with Ordinance XII of the University and no action shall be taken which shall be in contravention of any Statute, Ordinance or Regulations or Rule made by the University in this behalf.
    6. To appoint non-teaching staff excluding Class IV employees of the College.
    7. To grant, on the recommendation of the Principal, Study leave, Extra-ordinary Leave to the teaching staff of the college subject to the Rules and Regulations of the university and the directions of the  Univesity Grants Commission  from time to time.
    8. To institute, suspend or abolish such teaching and non-teaching posts, as may be considered necessary.
    9. To open an account or accounts in the name of the College with such scheduled bank or banks as the Governing Body may th8ink fit and to keep the funds of the College deposited with such banks.
    10. To take such insurance in respect of property of employees of the College, as the Governing Body may think fit.
    11. To make rules and to alter, amend or repeal the same, provided, all such alterations and amendments and repeals receive the approval of the University of Delhi.
    12. To exercise such other powers and to do such other acts or things as may be necessary or expedient for the proper performance of its duties.

The appointment of the teaching staff, their confirmation, extension of service, termination of service, grant of increment, scales of pay, leave, conditions of service and any dispute arising there form, will governed by the provisions laid down under Ordinance XVIII and conditions of Government grant to college, as amended from time to time
:           The Chairman may, whenever he thinks fit, and shall upon requisition in writing signed by not less than five members of the Governing Body, convene a special meeting of the Governing Body, Provided that no such meeting shall ordinarily be convened during any period of vacations.

The Secretary shall ordinarily circulate among the members a notice of such meeting a notice of such meeting of the Governing Body at least seven days before the date fixed for such meeting together with a statement of the nature of business to be brought before the meeting. The Chairman may direct, IN CASE OF EMERGENCY, special meetings to be called by a shorter notice. At every meeting of the Governing Body, 1/3rd of the members shall form the quorum.
ORDINANCE-XV

Colleges other than maintained by the Govt. of India.

  1. No college shall have more than 1000 students on its rolls, and in case of an extended college, not more than 1500 students except with the specific approval of the University.

 

1-A.A  College seeking recognition as a Constituent college must have an endowment fund of Rs. 5 Lakhs of which at least Rs. 3 Lakhs should be immediately available and the balance to be deposited within four years, and have either suitable building or a building fund of at least Rs. 3 Lakhs. it shall also satisfy the University that either it already has 7-8 acres of land (4.5 if there is no hostel attached) or has reasonable prospects of having the same for the college building.
      A College seeking recognition as an affiliated College must have an endowment fund of Rs. 3 Lakhs of which Rs. 2 Lakhs should be immediately available  and the balance to be deposited within two year, and have either suitable building or a building fund of at least Rs. 2 Lakhs. It shall also satisfy the University that either it already has a minimum of 3 acres of land(or 5 acres of land if hostel is attached) or has reasonable prospects of having the same.

      Provided that the provisions of this clause shall not apply in the case of a collge whose entire financial responsibility is borne by the Government of India, Delhi Administration in conjunction with the University Grants Commission.

1-B      Permanent Affiliation

(xii)     Subject to the provision of Statute 30, the Executive Council may
grant permanent affiliation to any institution if the following conditions are satisfied:

    1. that the constitution and personnel of the Governing Body are in accordance with the Ordinances and Statutes of the University.
    2. that the fees levied or proposed to be levied and the provision made for the continued maintenance and efficient working of the institution  in accordance with the rules and regulations laid down by the university.
    3. that satisfactory arrangement exist for library, laboratory (in case of science subjects) and other facilities and emoluments of the teaching and no-teaching staff and their terms and conditions of service are in accordance with the ordinances of the University.

(b)        The Executive Council may, if it is so desired, cause an institution to be inspected for the purpose of ascertaining that the above conditions are satisfied.

            Provided that no institution shall be granted affiliation unless it has a standing of one year, has fulfilled all the conditions of affiliation and attained the academic and administrative standards prescribed by the University from time to time.

  1. The Governing body will meet at least once in a term, and, subject as hereinafter provided, shall have general supervision and control of the affairs of the College and maintain its own. records of its proceedings which shall be open to inspection by the inspection authority.

 

  1. (1) The members of the Governing Body, other than the Principal,shall hold office for a period of one year and shall be eligible for re-appointment or re-election, provided that in respect of teacher representatives provisions of Sub-Clause (2) of this Clause shall apply.

Provided that on the expiry of one year the Executive Council may, either on the request of the Trust/Delhi Administration or on its won, as the case may be, if its is satisfied that the circumstances so warrant, extend the term of the existing nominees of the Trust/ Delhi Administration on the Governing Body for a further period not exceeding six-months but not more than three months, at a time.

provided further that on the grant of approval by the Executive Council the existing office bearers of the Governing Body shall continue to function as such for the extended period.

  1. The teacher’ representatives shall become members of the Governing body by rotation according to seniority. At least one of the representatives from among the teacher of the Day Classes and one of the representatives from among the teachers of the Evening Classes (where Evening classes are held and Evening teachers are represented on the Governing Body), shall be from among those with more than 10 years of service and at least one from among those from the Day classes and one among those from the Evening Classes with less than 10 year of service. If, however, eligible candidates are not available in one of those categories, namely, those with more than 10 years service and those with less than 10 year service, all the representatives may be taken from the other, The term of membership of teachers representatives shall be for a period of one year:

 

Provided that a teacher who has become a member of the Governing Body of College under the category of teachers with less than 10 year service and completes his ten year of service during the term of the membership as such, will Governing Body for the full term of one year.

      Note:-For the purpose of this Clause ‘teachers’ will be understood to be those holding a permanent whole time post, with requisite service in the College in question.

  1. The Governing Body shall elect from among its own member a Chairman to hold office for one year provided that this does not exceed his current term as a member of the Governing Body, and shall be eligible for re-election.
  2. (1) The Governing Body shall appoint a treasurer from among its own member to supervise the receipts and expenditure of the Governing Body , who shall be responsible for the proper keeping of its accounts.

 

The Accounts of the College shall be maintained in the name of the College and not in the name of a particular Trust or Society whether financing or sponsoring the College or not.

The appointment of Auditor to audit the account of the College shall be made in accordance with the procedure laid down in the Ordinance. The Audit Certificate shall be appended to the application for grant. The accounts of the College will be open to audit by the Comptroller and Auditor General of India at his discretion.

All funds, belonging to the College, or under the control of the Governing Body, shall be shown separately in the accounts of the college.

The College shall maintain the following bank accounts:-

    1. Capital
    2. Maintenance Grant
    3. Students’ Societies
    4. Development Fund
    5. OBC Fund

 

            All expenditure will be incurred in accordance with the rules to be framed for the purpose. There shall be a suitable imprest cash for Principal to meet the day to day contingent expenses.

  1. Investment of funds belonging to the College or under the control of the Governing Body shall be made in property and securities authorized by law for the investment  of trust funds or such other classes of security as may, from time to time, be approved by the Government of India, or in any other manner as may be specifically approved by the University Grant Commission.
  2. (i) In case it is deemed expedient to alter, extend or abridge the purpose for which the Society is established or to amalgamate wholly or partially with any other society or change any other clause of the Memorandum, the same shall be done in accordance  with the procedure laid down in Section 12 of  societies Registration Act 1860 (Act XXI of 1860)

 

(ii)The Governing Body may at any time amend any of the Rules of the Society but no such amendment shall be made which is not in conformity with the Act, Statutes and Ordinances, of the University and further no such amendment shall come into force unless the same is approved by the Executive Council of the University.

  1. The college shall not be closed without the consent of the University.

 

Staff Council

6-A     (1)  There shall be Staff Council in every College.
(2)   All the members of the teaching staff, the Librarian and the Directory of Physical Education shall constitute the Staff council.
(3)   Subject to the provisions of the Act, the Statutes and the Ordinances of the University, the Principal shall act as Principal-in-Council in respect of matters on which staff Council is required to take decisions.
                 
         (4)     (a)        The Principal shall be ex-officio Chairman of the Staff Council.
(b)        The Council shall elect its Secretary, who shall hold office for a term of one year. The Secretary may be re-elected for a second term but no person shall hold office of Secretary for more than two consecutive terms.

(5)                    (a)Subject to the provision of the Act, the Statutes and the Ordinances of the University, the Staff Council shall take decision in respect of the following matter:

    1. Preparation of college time-table
    2. Allocation of extra-curricular work of teachers not involving payment of remuneration.
    3. Organizing extra-curricular activities, including cultural activities of students, sports, games, national Service Scheme and other social service schemes and academic societies.
    4. Laying down guide-lines for purchase of library books and laboratory equipment in consultation with the appropriate department.
    5. Organizing admission of students.

 

B   Subject to the provision of the Act, the Statutes and the Ordinance of the University, the Staff Council shall make recommendation        in respect of the following matters:

  1. Formulation of recommendations on introduction of new teaching posts in the department and expansion of the existing department;
  2. Formulation of admission policy within the framework of the policy laid down by the University;
  3. Formulation of guidelines regarding arrangements for the residence and welfare of students in consultation with appropriate students organization;
  4. Formulation of guide-lines regarding discipline of the student;
  5. Formulation of policies for recommending name of teacher for participation in seminars and conferences and financial assistance to teachers.

 

Note: The Administrative staff of the college will not be within the purview of the Staff council.

B         (a)        The Staff Council shall function through committees appointed by the Council. Ordinarily  (i) no person shall be member of more than two Committees at a time and (ii) no person shall hold office as a member of a Committee for more tha two consecutive terms.

    1. The Principal shall have the right to be present and to speak at any meeting of any Committee.
    2. Each Committee shall have a Convener appointed by the Staff Council, who shall convene the meetings of the committee, and the minutes of the meetings shall be prepared and maintained by him.
    3. The decisions of the committee shall be reported to the subsequent meeting of the Staff Council for ratification, wherever necessary.
    4. The Principal shall implement all decisions of the Staff Council. If, “in the opinion of the Principal, however, any emergency has arisen which requires that immediate action should be take, the Principal shall take such action as he deems necessary and shall report the same to the next meeting of the Staff Council for confirmation.

Investment of Fund:

            Investment of Funds belonging to the College or under the control of the Governing Body shall be made in property and securities authorized by law for the investment or trust funds or such other classes of security as may, from time to time, be approved by the Government of India, or in any other manner as may be specifically approved by the University Grants Commission.

Provident Fund

      1. The Governing Body shall establish and maintain a Provident Fund for the member of the college Staff in accordance with Ordinance XVIII(10) and such other rules as may be approved by the Government of India.
      2. The accounts of the Fund shall be duly audited each year and a copy of the accounts so audited shall be furnished to each subscriber to the fund.
